Third party information v/s sec 8(1)

Pardon me for asking a very basic query. In third party queries PIO write letter to the concerned person and if he doesn't get a negative reply in given time PIO give that information to the RTI seeker. 

Is there any thing different in case of sec 8(1)  ??

The issue is no more res integra and this applies to third party personal information given in confidental nature to Govt.

Such referring application is just a formality to avoid further legal steps from that concerned person, proceeding against PIO for providing personal information.

Finally the discretion is left to only PIO.  If larger public interest is involved in seeking even personal information, information can not be denied and right from seeking information efforts can be made for establishing LPI, when it is suspected that PIO may deny information.
