Filed RTI seeking official mobile number and official email id of Chief Secretary, State of TN with DOPT vide online RTI portal

RTI was returned by CPIO with remarks as follows

 

As mentioned in the guidelines for use of this portal, this facility is not available for filing RTI applications for the public authorities under the State Governments, including Government of NCT Delhi. Since your RTI application is meant for a public authority under the State Government of Tamil Nadu , the same is returned herewith. You may file the same before the concerned public authority under the State Government.

 

Again today , I filed the same query with CPIO, Ministry of Home Affairs. They Accepted the RTI application and transferred to DOPT u/s 6(3)

Can I go for Appeal ?

India has adopted a federal governance system, whereby, there is a central government and then each of the state has its respective state government. The subject over which the central govt. and each of the state govts has jurisdiction is given in three lists of seventh schedule to the Constitution of India.

Therefore, ideally, for seeking information on a state govt. subject you should have filed your RTI application with the concerned state govt. public authority.

However, so far as, contact information of the Chief Secretary is concerned it ought to have been available with the said central govt public authority, and the PIO should have provided it and resolved a simple issue.

It is up to you whether to file a first appeal or approach the concerned state govt public authority.

I suppose, if you search a bit on google, such information ought to be available on the internet itself, rather than using RTI.

Searching website of that authority, from whom certain information is required is fundamental aspect in RTI.  Under RTI Act, public authorities must upload certain important information as voluntary disclosure in their websites to avoid separate RTI Applications from pubic.  Search in google website of Chief Secretary, TN and then you can decide further course of action.

CPIO MHA transferred my application u/s 6 (3)  to CPIO , DOPT . As usual CPIO disposed  my  RTI application seeking official mobile number and official email id of Chief Secretary, State of TN As mentioned in the guidelines for use of this portal, this facility is not available for filing RTI applications for the public authorities under the State Governments, including Government of NCT Delhi. Since your RTI application is meant for a public authority under the State Government of Tamil Nadu , the same is returned herewith. You may file the same before the concerned public authority under the State Government.
