Can I obtain copy of written submission submitted by PIO in compliance of Information Commissioner decision from Central Information Commission as per following draft to obtain information..



Information commissioner sh. Heera Lal Samariya given his decision in Complaint No. CIC/NDMCN/C/2019/659375 with out taking the submission made by complainant during audio hearing and based on PIO submission, disposed off the Complaint filed u/s 18 of the RTI act with the following decision:
Therefore, Commission direct then PIO through the present PIO to send his written submissions to justify as to why action should not be initiated against him/her under section 20 of the RTI Act for the gross violation of its provisions. In doing so, if any other persons are also responsible for the omission, the then PIO shall serve a copy of this order on such other persons under intimation to the Commission and ensure that written submissions of all such concerned person sent to the Commission. The said written submission of then PIO along with submissions of other concerned person, if any, should reach the Commission within 30 days after when current situation normalizes and PIO rejoins the office.
The present PIO, O/o Jt. Director (Civil), Civil Estt., NDMC will ensure service of this order to then PIO.
Therefore, under the section 6 of RTI Act, 2005 following information may be provided.
1.Please provide me copy of written submissions submitted by PIOS in compliance of directions/decision dated 28.05.2021 in Complaint No CIC/NDMCN/C/2019/659375 of the Information Commissioner.
2. Since PIO, NDMC New Delhi not yet provided any information even after lapsed of about 22 months, as informed during audio hearing, please provide me relevant rules which provides the disposed of complaint filed under section 18 of the RTI Act according to decision received by complainant

You have such rights and can file rti application.  Infact it is an obligation of authority.  But many PIOs use it to spit venom against applicant through such direct letters to IC.  Those that are having influence may get the same incorporated in decisions through registry in decision as warning etc.,.  All these tactics to demoralize applicants to suppress facts.

Further a writ petition has been filled by me before the Honeble Delhi High court against the order of the Information Commissioner as per attached writ petition.

The Honeble Justice Rekha Palli issued the notice and accepted by Commission lawyer with the direction to file the reply in 4 week's and rejoinder after reply if any within 4 week's. Further directed to list the matter on 4th February of 2022.

Unfortunately, lawyer of the Commission not yet file any reply.

If I remember well, you have to file writ against CPIO or public authority, and IC is beyond ambit of writ for his decisions.

You are aware that unless it is served on you, court may not list it for further hearing.
