Citizens have right to access file noting under RTI

Finally a controversy is put to an end. Though CIC in earlier judgement propounded the principle, the information on the ministry website was creating a dichotomy.

All well if ends well.

This is interesting! In a recent meeting of Bhopal Chapter of CAISPA(Central and All India Services Pensioners Association) presided by a very Senior IPS of 1950s it was felt that the present officers in the secretariat failed to provide any information to the Association Secretarys Letters and that they cshould find out whether the Association as an NGO can file cases against Govt under RTI! Surprisingly the lethargic State Govt has not even cared to fill the vacant post of CPIO after term of Shri TN Srivastava finished! The cases must be accumulating and the Govt need to be shaken out of their slumber! Hari Gautam Obhrai

New Delhi, Feb 01: Putting an end to ongoing debate over disclosure of file notings, the Central Information Commission (CIC) has directed the Department of Personnel and Training (DoPT) to amend the contents of its website which stated that file notings cannot be divulged under the Right to Information Act.

 

Here is a cofusion as reveled from the FAQ section of Orissa RTI portal where file notings are still exluded from informations .Pl view FAQ section which says

3. What does information mean?

Information means any material in any form including records, documents, memos, e-mails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, models, data material held in any electronic form and information relating to any private body which can be accessed by a public authority under any other law for the time being in force but does not include "file notings". [s.2(f)].

Is the CIC order not applicable to Orissa?

Dear Inkhandual,

 

The CIC decision is binding to Orrisa Govt. also. However, the same has to be

ratified by the SIC, Orrisa for the purpose of implementing in the Orrisa State, which I presumbly

hope.

 

Best of luck, you may derive benefits out of the judgment of the full bench.
