When to file second appeal

Let's say I file an RTI application. Do not receive a reply from CPIO within 30 days. File the first appeal with the appellate authority. Receive a reply from the CPIO. But the reply is unsatisfactory.

 

Now, my question is, should I file another appeal with the appellate authority or go to the information commissioner this time? Note that there's still time before it will be 30 days since I've filed the first appeal with the appellate authority.

Dear Member

 

Second Appeal with SIC/CIC (as per the case) within 90 days from the last reply of FAA or the date when it was supposed to be received.

 

RTI procedure is :Time limits specified in the RTI Act - RTI Guide

1. RTI Application with Fee to PIO

2. If no reply/ not satisfied with reply in 30 (or 35 days in case of submission to APIO or under Section 6(3)),

First Appeal to the First Appellate Authority (normally a officer higher than the PIO)

3. If no reply/ not satisfied with reply in 45 days to the First Appeal, then Second Appeal to the CIC/SIC (time period is 90 days)

To clarify, I received my reply not from the Appellate authority but from the CPIO itself. This was after filing the first appeal and about 50 days of filing the RTI application.

 

My question is, do I need to file another first appeal with the appellate authority for unsatisfactory reply or wait for 45 days getting over and then go to CIC.

As u got the information after filing First Appeal and u are not satisfied with the provided info, in this case file addendum/rejoinder to First Appeal with FAA and explain each and every thing clearly in the same.
