Received a receipt from MCD

I filed RTI month back with MCD, during this period, MCD officials visited my place and tried to explain that due to budget constraints the task could not be undertaken and now after one month I have received a receipt, FORM G8 A, stating RTI registration fee of 10/-. mode of payment is cash. I am completely at my wit's end about this . Why have I received this receipt when I was expecting response from MCD. Does it mean, my RTI has been cancelled or what?

Please suggest me the next steps and what can I do to get required information.

Did you enclose any fee along with your application? You were suppose to pay a fee of Rs. 10 in case/IPO/Draft etc.

 

In case you have not paid any fee, the PIO is right to reject/cancel your application.

I did pay Rs. 10/ to Accounts Officer and it has been debited from my account.

Does this means my RTI has been cancelled even on paying the fee? Is this right to cancel the RTI without mentioning a reason or informing the person about the reason for rejection.

Please dont be confused between receipt of fee and information. MCD has given you the receipt of amount you have paid but not the information you have requested.

 

A RTI application should be replied by PIO within 30 days of receipt of application but we normally take it 35-40 including postal delay of both sides. So if you dont get the information upto 40th day, file first appeal with the first appellate.

 

As per my three years experience in which I have filed several RTI with MCD, the PIOs normally dont answer the application unless a first appeal is filed. Since only 50% of the applicants know the route of first appeal, they are purposely taking this trend.

Surprising, this is my second RTI with MCD. For the previous application, I never received any receipt from MCD but I received the response timely. But this time, I have received receipt and no response. You may be right, postal delay could be the reason for actual delay, but it is unlikely as they usually send it through speed post.

Let me wait for another week and then I may file my first appeal. But for filing first appeal I do not have any Id assigned from MCD, which I can mention in appeal. Any idea, how to go about it in case I file first appeal.

For filing first appeal you need not to have the ID No. Just provide date of application and attached copy of your RTI application.

 

In case you dont get reply within 40 days, you should file your complaint also with CIC . The complain can be filed online. Click here to visit online filing system.

 

Please note that the online complaint system has some error. It will not accept the dates of year 2011. So while submitting your application select the year 2010 instead of year 2011. Also submit online the scanned copy of your RTI application and proof of dispatch.

 

After submitting your application online, take a printout of the application filed online, sign on each page and then send it to the CIC office by post along with copies of your RTI application and proof of dispatched. The benefit of filing such complaint online is that you can check the status of your complaints online .

 

CIC will issue notice to PIO under section 18 of the RTI Act within two month approx.

You have to file a first appeal or a complaint. The first appeal has to be settled time bound but the complaint will take its own time, may be years.

I am filing my appeal on CIC portal. As suggested by you, that we should also send the attested copies of the printouts and other documents, can you also please confirm the address for CIC. Is below given address the right one, or I should also mention some particular department/section
